1. Promotion Description
The "Newton Baby Gift Card Giveaway" ("Sweepstakes") is an ongoing monthly promotion with no scheduled end date. Each monthly entry period begins on the 1st of the month at 12:00 AM (Eastern Time) and ends on the last day of the month at 11:59 PM (Eastern Time) (each, a "Promotion Period"). By participating, each entrant unconditionally accepts and agrees to comply with these Official Rules and the decisions of Pregnant Chicken ("Sponsor"), which are final and binding in all respects. Sponsor is responsible for the collection, submission, and processing of entries and the overall administration of the giveaway. Entrants should direct all questions, comments, or problems to Sponsor.
2. Eligibility
Open to legal residents of the United States who are 18 years of age or older at the time of entry. Void where prohibited or restricted by law. Sponsor and Newton Baby, and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies, and each of their respective officers, directors, and employees (collectively, the "Promotion Entities"), along with members of their immediate families and/or persons living in the same household, are ineligible to enter or win.
3. Winner Selection
One winner will be selected each Promotion Period in a random drawing from among all eligible entries received during that Promotion Period, conducted within 7 days of the Promotion Period's end. Odds of winning depend on the number of eligible entries received. The winner will be notified by email at the address provided at entry, on or before 7 days after the drawing. The winner must accept the prize by replying to the notification email within 7 days, or an alternate winner may be selected. Any notification not responded to, or returned as undeliverable, may result in forfeiture. The winner may be required to sign and return an affidavit of eligibility, liability release, and publicity release. No substitution or transfer of the prize is permitted except by Sponsor.
4. Prize
One (1) winner per Promotion Period will receive a $500 USD Newton Baby Gift Card. Approximate Retail Value: $500. Only one prize per person and per household will be awarded across the life of the Sweepstakes, unless Sponsor decides otherwise. The gift card is subject to the terms and conditions of Newton Baby as issuer. The prize cannot be transferred, redeemed for cash, or substituted by the winner, except that Sponsor reserves the right to award a substitute prize of equal or greater value if the stated prize becomes unavailable. The prize will be fulfilled directly by Newton Baby via email to the address the winner provided at entry. Sponsor will not replace any lost, stolen, or undelivered prize. All federal, state, and local taxes, fees, and surcharges are the sole responsibility of the winner.
5. Online Entry
Enter during the applicable Promotion Period by submitting your email address via the entry form at pregnantchicken.com. Limit one (1) entry per person, per email address, per Promotion Period. Automated, robotic, or bulk entries will be disqualified. Entry must be made by the entrant personally. Any attempt to obtain additional entries using multiple or different email addresses, identities, or any automated entry method will void those entries and may result in disqualification. Sponsor's database clock is the official timekeeper for this Sweepstakes.
6. Privacy
Personal information submitted as part of this Sweepstakes may be shared between Sponsor and Newton Baby for purposes of administering the Sweepstakes and fulfilling the prize. Sponsor does not sell or share entrants' information with any other third party. If selected as a winner, certain identifying information (such as first name) may be disclosed publicly as required by law or as described in Section 7 below.
7. Promotional Emails & Publicity
By entering, all entrants consent to receive promotional emails from both Pregnant Chicken and Newton Baby, and may unsubscribe at any time. Except where prohibited by law, acceptance of the prize constitutes the winner's consent for Sponsor to use their first name and state of residence for promotional purposes related to the Sweepstakes, without additional compensation.
8. Limitation of Liability
Sponsor is not responsible for incorrect or inaccurate entry information, whether caused by entrants or by equipment or programming used in the Sweepstakes, or for any technical or human error in processing entries. Sponsor assumes no responsibility for lost, misdirected, or delayed entries or notifications, or for any interruption, error, or unauthorized access affecting the Sweepstakes, including issues arising from internet, email, or computer system failures. If the Sweepstakes cannot run as planned due to fraud, technical failure, or any cause beyond Sponsor's control that affects its administration, security, fairness, or integrity, Sponsor reserves the right to cancel, terminate, modify, or suspend the Sweepstakes, and may, at its discretion, select a winner from eligible entries received prior to or after such action. In the event of a dispute over entry authorship, the entry will be deemed made by the authorized holder of the email account used to enter; Sponsor may request proof of this. Unresolved disputes will result in the entry being deemed ineligible.
9. Governing Law
This Sweepstakes is governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
