1. Promotion Description The “Newton Baby Mattress Giveaway” consists of a series of separate, independent monthly promotions offered by Pregnant Chicken (“Sponsor”). Each is referred to individually as a “Sweepstakes.”
Each Sweepstakes has its own entry period (the “Promotion Period”), running from the 1st of the applicable month at 12:00 AM ET through the last day of that month at 11:59 PM ET. Each monthly Sweepstakes is independent of, and unrelated to, every other monthly Sweepstakes, with its own Promotion Period, drawing, and prize.
Non-winning entries do not carry over from one Promotion Period to the next. Entrants must submit a new entry during a given Promotion Period to be eligible for that Sweepstakes’ drawing.
By entering, entrants agree to comply with these Official Rules and accept Sponsor’s decisions as final and binding. Sponsor administers each Sweepstakes and handles all entry collection and processing. Entrants should direct questions to Sponsor.
2. Eligibility Entrants must be legal U.S. residents who are 18 years of age or older at the time of entry. Void where prohibited.
The following are ineligible to enter or win:
- Sponsor and Newton Baby, along with their parents, subsidiaries, affiliates, distributors, retailers, sales representatives, and advertising/promotion agencies (collectively, the “Promotion Entities”)
- Officers, directors, and employees of any Promotion Entity
- Immediate family members and household members of the above
3. Winner Selection One winner will be selected for each Sweepstakes, chosen at random from all eligible entries received during that Sweepstakes’ Promotion Period. The drawing will occur within 7 days of the Promotion Period’s end. Odds of winning depend on the number of eligible entries received.
The winner will be notified by email at the address provided at entry, no later than 7 days after the drawing. The winner must accept the prize by replying within 7 days of notification; failure to respond, or an undeliverable notification, may result in forfeiture and selection of an alternate winner. Sponsor may require the winner to sign an affidavit of eligibility, liability release, and publicity release. No substitution or transfer of the prize is permitted except by Sponsor.
4. Prize One (1) winner of each Sweepstakes will receive one (1) Newton Crib Mattress ($300 value) (the “Prize”).
- The Prize cannot be combined with other offers, discounts, or promotions.
- Only one Prize per person or household will be awarded across the life of this Giveaway, unless Sponsor determines otherwise.
- The Prize is subject to Newton Baby’s terms and conditions as manufacturer, and is fulfilled and shipped directly by Newton Baby.
- The Prize cannot be transferred, redeemed for cash, or substituted by the winner. Sponsor may substitute a prize of equal or greater value if the stated Prize becomes unavailable.
- Sponsor is not responsible for replacing any lost, stolen, or undelivered Prize.
- All taxes, fees, and surcharges associated with the Prize are the sole responsibility of the winner.
5. Online Entry Entrants may enter during the applicable Promotion Period by submitting their email address via the entry form at pregnantchicken.com. Limit one (1) entry per person, per email address, per Promotion Period.
Automated, robotic, or bulk entries will be disqualified. Entry must be made personally by the entrant; use of multiple identities or automated entry methods will void the relevant entries and may result in disqualification. Sponsor’s database clock serves as the official timekeeper for each Sweepstakes.
6. Privacy Personal information submitted in connection with a Sweepstakes may be shared between Sponsor and Newton Baby solely to administer the Sweepstakes and fulfill the Prize, including sharing a shipping address for delivery. Sponsor does not sell or share entrant information with any other third party. If selected as a winner, certain identifying information (such as first name) may be disclosed publicly as required by law or as set out in Section 7.
7. Promotional Emails & Publicity By entering, entrants consent to receive promotional emails from Pregnant Chicken and Newton Baby, and may unsubscribe at any time. Except where prohibited by law, acceptance of the Prize constitutes the winner’s consent for Sponsor to use their first name and state of residence for promotional purposes related to the Sweepstakes, without additional compensation.
8. Limitation of Liability Sponsor is not responsible for incorrect or inaccurate entry information, whether caused by entrants or by equipment or programming errors, nor for any technical or human error in processing entries. Sponsor assumes no responsibility for lost, misdirected, or delayed entries or notifications, or for any interruption, error, or unauthorized access affecting a Sweepstakes, including issues arising from internet, email, or system failures.
If a Sweepstakes cannot proceed as planned due to fraud, technical failure, or any cause beyond Sponsor’s control affecting its administration, security, fairness, or integrity, Sponsor may cancel, terminate, modify, or suspend that Sweepstakes, and may select a winner from eligible entries received before or after such action, at its discretion.
In the event of a dispute over entry authorship, the entry will be deemed made by the authorized holder of the email account used to enter. Sponsor may request proof of this; unresolved disputes will result in the entry being deemed ineligible.
9. Release As a condition of entering, entrants agree, and agree to confirm in writing, that:
a) They release Newton Baby, its affiliates, subsidiaries, retailers, and agents from any and all liability, loss, or damage arising from participation in the Sweepstakes, or from the awarding, receipt, possession, use, or misuse of any prize or item redeemed with it.
b) They waive all rights to punitive, incidental, consequential, or other damages beyond actual out-of-pocket expenses, and waive any right to have damages multiplied or increased.
c) Any cause of action arising from a Sweepstakes, or any prize awarded, will be resolved individually, without resort to class action.
d) Any claims, judgments, or awards are limited to actual out-of-pocket costs incurred, if any, excluding attorneys’ fees and court costs.
10. Governing Law Each Sweepstakes is governed by the laws of the State of Florida, without regard to conflict of law principles. Each entrant consents to the exclusive jurisdiction of the state and federal courts located in Florida for any disputes arising out of or relating to a Sweepstakes.
